Нашел поддержку среди сенаторов-южан, недовольных решениями Суда под председательством Уоррена [ Warren, Earl] в области десегрегации [ desegregation]. В первоначальном варианте законопроект провалился. Через год Дженнер пересмотрел текст по рекомендации другого республиканца, Дж. Батлера [Butler, John Marshall] в сторону возможности отмены решений Суда, а не пересмотра его юрисдикции.
